Crocs, the company that makes those very popular plastic clogs, has filed suit against Old Friend Footwear and in retailiation, Old Friend Footwear has filed a motion in which the company claims:
1) That Crocs filed its complaint with the ITC accusing a shoe that Australia Unlimited no longer makes despite having knowledge of that fact
2) That material information about the original design of Crocs' shoe, which includes activities in 2000 by an Italian designer, was not disclosed by Crocs during prosecution of its patents in the US
3) That NOTHINZ (foam footwear) has not infringed on any patents or trade dress claimed by Crocs, because, among other things, NOTHINZ are sold in distinctive packaging and NOTHINZ have a distinctively different ventilator pattern than Crocs.
Old Friend believes that Crocs is using this lawsuit to try and elminate
them as a competitor. I'm not familiar with the NOTHINZ brand of footwear, so I can't give a definitive opinion on the claim. I have taken a look at the NOTHINZ clogs and yes, the shoes do look very similar to Crocs. Anybody with thoughts?

Oh they completely copied Crocs, they're exactly the same!
Why can't someone use some nice technology but create a nicer looking shoe? That would be more successful. What these people are doing is not competing in a market, but cashing in on COUNTERFEIT,KNOCKOFF, REPLICA ... FAKES!!! They need to be shut down.
